Possession of marijuana:
- You may face a mandatory suspension or disqualification of your CDL for at least 1 year, especially if the offense occurred while operating a commercial motor vehicle (CMV)
Even if the offense occurred in your vehicle:
- States must report criminal drug offenses–including marijuana possession–to the CDLIS (Commercial Driver’s License Information System).
- FMCSA and employers may treat this as a serious offense that requires a DOT SAP Program
How to Reinstate Your CDL After a Possession Charge
Step 1: Complete Legal Requirements
You must resolve the criminal charge, which may include:
- Court-ordered alcohol and drug evaluation
- Probation or diversion program
- Completion of any required treatment or education
- Courts may require documentation of compliance before lifting restrictions on your license.
Step 2: Begin the DOT SAP Program
The SAP Process Includes:
- Initial Evaluation – Meet with a DOT-qualified Substance Abuse Professional (SAP)
- Treatment Recommendation – Complete classes or treatment as prescribed
- Follow-Up Evaluation – SAP confirms successful
- Return-to-Duty Drug Test – Directly observed and must be negative
- Follow-Up Testing Plan – At least six unannounced tests over 12 months
Until you complete this process, you cannot legally return to safety-sensitive duties.
Step 3: Reapply for CDL Reinstatement
Once the suspension period is complete and you’ve met all legal and SAP requirements:
- Submit proof of SAP compliance and a negative RTD
- Pay reinstatement fees to the state licensing
- Provide any court documentation
