The Department of Transportation (DOT) is solely responsible for ensuring that all commercial motor vehicles (CMVs) are operated safely. To that end, the agency has established rules and regulations governing the use of CMVs. One of these rules is the “Return to Duty” regulation.
The Return to Duty regulation requires that any driver who has been found to have violated a DOT regulation must successfully complete a DOT-approved rehabilitation program before he or she can be allowed to operate a CMV again. The principal purpose of the rehabilitation program is to ensure that the driver has the know-how and skills required to operate a CMV safely.
There are a number of DOT-approved rehabilitation programs available, and the driver must choose one that meets his or her needs. The program must be finished within 90 days of the driver’s last violation. Once the program is successfully completed, the driver must pass a DOT physical and skills test before he or she can be reinstated.

The first step in the RTD process is the employee must complete a DOT return to duty drug test. The test must be conducted by a DOT-certified laboratory and must be negative for all drugs. The employee will need to sign a Consent for Release of Information form that will allow the SAP to access their medical records.
Once the drug test is complete, the SAP will conduct an evaluation to determine if the employee is able to return to work. The evaluation will take into account the employee’s history of substance abuse, the circumstances of the removal from duty, and any treatment the employee has completed.
