The 6 Steps of the DOT Return-to-Duty Process

The RTD process follows a strict, federally mandated sequence. Steps cannot be skipped or reordered. Here is a full breakdown:

Step 1: Immediate Removal from Safety-Sensitive Duties

Upon a confirmed violation, your employer is legally required to remove you from all safety-sensitive functions immediately with no exceptions. This means no driving, no operating heavy machinery, and no performing any DOT-regulated safety role until the full RTD process is completed.

Your employer must also provide you with a list of DOT-qualified Substance Abuse Professionals (SAPs) for referral. Note that while employers must provide this list, they are generally not required to pay for your SAP evaluation or treatment costs; that is typically the employee’s responsibility.

Step 2: Initial SAP Evaluation

Your first step as the employee is to contact a DOT-qualified substance abuse professional and schedule a face-to-face evaluation. This is a thorough clinical interview where the SAP will assess:

  • The nature and severity of your violation
  • Your personal substance use history
  • Any prior treatment or counseling
  • Your overall readiness for education or treatment

This evaluation must be conducted in person; it cannot be done over the phone or by video. The SAP will then send a written report to your employer outlining a recommended treatment or education plan.

Step 3: Complete the SAP-Recommended Treatment or Education

Based on the initial evaluation, your SAP will prescribe a specific program. This may include:

  • Substance abuse education programs
  • Outpatient counseling sessions
  • Inpatient rehabilitation (in more severe cases)
  • Group or individual therapy

You must complete this program fully and satisfactorily before you can move to the next step. Partial completion does not qualify you to proceed. Your SAP will monitor your progress throughout this phase.

Step 4: Follow-Up SAP Evaluation

Once you’ve completed treatment, your SAP will conduct a second face-to-face evaluation to verify that:

  • You completed all recommended treatment requirements
  • The treatment was clinically successful
  • You are fit to return to safety-sensitive duties

If the SAP determines the treatment was successful, they will issue a written report of compliance to your employer. If not, additional treatment may be prescribed before you can move forward.

Step 5: Pass the Return-to-Duty Drug/Alcohol Test

With SAP clearance in hand, your employer can now order your return-to-duty test. Key details about this test:

  • It must produce a negative drug test result and/or an alcohol concentration below 0.02
  • The specimen collection is conducted under direct observation, no exceptions.
  • This test cannot be substituted for a standard pre-employment test

Only after a negative RTD test result can your employer formally clear you to resume safety-sensitive duties. If this test comes back positive, you will have a new violation and must restart the entire process from Step 2.

Step 6: Follow-Up Testing Plan

Returning to duty is not the end of the process. Your SAP will establish an unannounced follow-up testing plan that includes the following:

  • A minimum of 6 tests in the first 12 months after returning to duty
  • The plan can extend up to 5 years, depending on your clinical history
  • Alcohol testing is required within the first 12 months
  • All tests are unannounced and conducted at the SAP’s discretion

Failing to comply with follow-up testing is itself a DOT violation and will trigger removal from duty again.
