Operational violations include the following:

What Happens Immediately After a Drug or Alcohol Violation?
A drug or alcohol violation triggers an immediate and automatic sequence of events under federal law. Here’s what happens the moment a violation is confirmed:
1. Immediate Removal from Safety-Sensitive Duties
Your employer is legally required to remove you from all safety-sensitive functions the moment a violation is confirmed, no exceptions. For commercial drivers, this means:
- No driving a commercial motor vehicle (CMV)
- No operating any DOT-regulated safety-sensitive equipment
- No returning to work in a safety-sensitive capacity under any employer
This removal is not optional and cannot be waived by your employer, no matter how long you’ve worked for them.
2. Violation Is Reported to the FMCSA Clearinghouse
Within 3 business days, your employer must report the violation to the FMCSA Drug and Alcohol Clearinghouse, the federal database that tracks all drug and alcohol violations for CDL holders. This means:[
- Every future DOT-regulated employer must check this database before hiring you
- Your status in the Clearinghouse will show as “Prohibited” meaning no employer can place you in a safety-sensitive role
- Your CDL reinstatement is blocked until the full Return-to-Duty process is complete

3. Your Employer Must Provide a SAP Referral List
Federal regulations require your employer to hand you a list of DOT-qualified Substance Abuse Professionals (SAPs) at the time of removal. This is your roadmap back to work. It is your responsibility, not your employer’s, to contact a SAP and begin the evaluation process.

- Follow-up SAP evaluation to confirm successful completion
- Directly observed Return-to-Duty (RTD) drug/alcohol test must return negative
- Unannounced follow-up testing plan for up to 5 years, with a minimum of 6 tests in the first 12 months
There are no shortcuts. Every step must be completed in order before your Clearinghouse status changes from “Prohibited” to “Not Prohibited.”

Operational violations carry a different but serious set of consequences:

However, for drug and alcohol violations confirmed by an MRO, the dispute process is different and more limited under 49 CFR Part 40.
How Long Does a DOT Violation Stay on Your Record?
- Drug & alcohol violations remain in the FMCSA Clearinghouse for 5 years from the date of violation, or until the RTD process is completed, whichever is later
- CSA score violations from roadside inspections typically remain on record for 2–3 years
- Employers querying the Clearinghouse can see your full violation history within that window
